The rights and
equality of peoples and development of every sector is the main priority of
governing body of any country. To ensure the rights of people and to discard
autocracy by abolishing tyranny, many countries in the world had gone through
their own level of struggle. In some countries the people’s voice was portrayed in
the law and rule of law was efficient whereas in some countries, political
chaos and dispute was the outcome. But most of the countries now are practicing
democracy. The people’s agendas, duties are represented in the law of the
respective countries.
Nepal is
practicing the federal republic democracy for the first time in our history. Recently, the
promulgation of the constitution in Nepal by more than two third constitution
assembly members shows the mutual understanding between the parties (though
they have prioritized various agendas) to end the transition phase of the
country followed by the effect of recent big earthquake. In that sense, the
move taken to promulgate the constitution was applauded by many people within
the country and also from the international communities as well. But, the
recent conflict in terai region of Nepal has left the people be saddened and
desperate as the madhesh based leaders are leading the strike. They are
discarding the constitution as they feel that it doesn’t guarantee the true
agendas of the people living in madhesh. Another interesting fact is that Madhesh based leaders are taking
themselves as the representatives of the whole area of terai despite of the
real calculation of their true supporters in numerical basis.
On the other
hand, the big III parties are ensuring the inclusion of the agendas of Madhesh
as well as every marginalized group in the constitution. They are also focusing
to include true agendas by the amendments and via various commissions. But, this unrest within the country had also aroused
so many Indo-Nepal issues (blockade of boarder and other diplomatic issues) recently
and soon becoming the concerns in an International level.
Series of
question arises that is all about the health and true aspirations of democracy
and its implementation in Nepal. Are we ready to practice the methodology, core
values and norms of democracy? Are we ready to listen to the voice of every
people and search the common mandate to address it via governing bodies? Are we
mature enough to handle any hardships that come into our way while implementing
the laws? And off course an important
question is, What about the procedures of democracy that we have adopted till
now? Are they correct?
Let’s not figure
out and advocate weather the procedures of democratic principles that are
adopted in the country are correct or not as we are already became successful
to some extent. But, the background of the democracy shouldn’t be forgotten if
we are calling ourselves a democratic country. The election is one of the main procedures of
democracy. We have promulgated the constitution by this method that includes
the people’s participation which is really a healthy practice.
The madhesi leaders stood
against this fundamental procedure of election and went to protest. Again we
also should understand the Maoist agitation in the past years during their ten
years of revolution was also an undemocratic way to address the rights of the
people. Many revolutions and reforms in the past had established some
changes and ensured the rights and equity of citizens in the country but the
rule of law and order has not been maintained. Still there is conflict and
people are getting killed in order to ensure the fundamental rights to the people.
So, provision of addressing every group either minority or indigenous should be
in a healthy way and without bloodshed. Those laws should be included in the
constitution and strict implementation of the laws regarding violence is the
way of ending the dispute and chaos prevailing in the country.
The
strengthening of the constitution by the peaceful talks by government with the
agitated groups in terai could be the solution. Also, the healthy practice of
the opposition parties in parliament shouldn’t be unconstitutional and
undemocratic in coming days.
